The announcement was made on X on Monday, following proceedings at the Kibera Law Courts where Senior Principal Magistrate Irene Kahuya delivered the judgment on 29 June 2026.
The DPP said Principal Prosecution Counsel Hilda Omondi led the prosecution, which presented evidence from six witnesses linking Cleff Juma Mbaka and Mursal Kafe alias Muu Nasur to the offences.
“The prosecution, led by Principal Prosecution Counsel Hilda Omondi, presented compelling evidence through six witnesses, establishing that the victim was lured to Nairobi under the guise of a business opportunity before being robbed of his mobile phone, cash and personal documents,” the DPP said.
The court heard that the complainant was later drugged, sexually assaulted, gang raped, and abandoned at Lang’ata Cemetery with severe injuries that required emergency surgery.
The prosecution relied on the complainant’s testimony, medical evidence, a motorcycle tracking report, documentary exhibits, and circumstantial evidence. The defence of mistaken identity was rejected.
The court sentenced the two convicts to 30 years’ imprisonment for robbery with violence, 20 years for gang rape, and 20 years for sexual assault. The sentences will run consecutively, resulting in an effective 70-year custodial term, with eight months already spent in custody taken into account.
