Man who insulted his father pleads guilty to causing a disturbance

A 22-year-old man who hit his father with a table and hurled verbal abuse at him at Obama Estate in Njiru sub-county, Nairobi, has pleaded guilty to a charge of causing a disturbance in a manner likely to cause a breach of peace contrary to Section 95 (1) of the Penal Code.

Derrick Musau admitted to banging and pushing a table which hit his father Lazaro Wanguu on 3 June.

Mr Musau was also charged with using abusive language in a manner likely to cause a breach of the peace contrary to Section 95 (1) (a) of the Penal Code for allegedly insulting his father on the same day. He threatened to kick his father out of the house.

Mr Musau pleaded guilty before Principal Magistrate Eric Mutunga of the Makadara Magistrate’s Court.

Mr Wanguu, a businessman in the area, was sitting in his house when his son entered with a cup of tea and started insulting him.

The complainant asked his son what was wrong with him, but the accused moved towards his mother intending to hit her and demand money, prompting Mr Wanguu to intervene.

Mr Musau left the house cursing his father, threatening to pour the tea on him and warning that he could evict him from the house.

Mr Wanguu reported the matter to the Obama police station and his son was arrested.

Neighbours who heard Mr Musau insulting his father recorded statements with the police and were listed as witnesses.

However, they will not testify in court after the accused pleaded guilty after the charges were read to him.

Mr Mutunga remanded the accused in custody until 9 June when the prosecution will present its case against him before he is convicted and sentenced.
