Kilifi South MP Ken Chonga, County Speaker Teddy Mwambire and two others have been released on a Ksh.100,000 bond or an alternative cash bail of Ksh.50,000.
In a ruling on Monday Chief Magistrate Martha Mutuku said the prosecution has not advanced compelling reasons to deny the accused bond.
The court has also ruled that being civil servants, there were no reasons to direct the accused to report to Investigators, instead they were ordered to appear throughout their trials before the court.
The legislators were arrested in Mtwapa on Wednesday, July 19, where they had gathered to address residents before the kick-off of anti-government protests.
They were charged with participating in unlawful assembly contrary to Section 78(1) of the Penal Code.
The other accused were Victor Katana (Chonga’s aide) and Patrick Chiro (a worker in Kilifi Senator Stewart Madzayo’s office).
