A Nairobi court has granted a Ksh.300,000 cash bail to Abdi Yusuf, whom the prosecution claims is linked to Garissa attack mastermind Mohamed Kuno alias Gamadhere.
In a ruling on Thursday, Magistrate Agnes Mwangi said that the allegations have not been proven and denying the accused person bail will be unfair.
“It will be unfair for a court to act on such information who is entitled to be presumed innocent till found guilty. I find no merit in that argument,” court ruled.
In the case Abdi Yusuf has been charged with obtaining a National Id card by pretending he was the son of Ralia Mohammed Wardere alias Iron Lady a fact he knew to be false.
The court noted that the claim that he is a Somali National has not been proven, adding that it still remains to be allegations.
He is also facing another count of forging the said ID card and being in the country illegally.
He also pleaded not guilty to another count of uttering the ID card as genuine.
The Investigating officer in the case in seeking to have the accused denied bail claimed that he used an identification card belonging to one Abdi Yusuf Ali a brother to Mohammed Kuno alias Sheikh Mahamud aka Gamadhere, who is alleged to be the mastermind of the Garissa University attack.
Earlier the accused had been charged with obtaining 5.6 million shillings from Businessman Hassan Ali Hassa by falsely pretending that he was in a position to import assorted cosmetics ,Nutella , Chocolates and aptamill from Europe a fact he knew to be false.
He is out on a cash bail of Ksh. 300,000 and case is set for mention on October 12.
