The Competition Authority of Kenya (CAK) has issued a stern warning regarding the rise of impersonators defrauding businesses across the country under false pretences.

In a press statement issued on Friday, the CAK pointed out that individuals and organizations claiming affiliation with the authority have been targeting businesses in various regions including Mombasa, Embu, Machakos, Ruiru, Nyeri, and Meru.

According to the CAK, the impostors have been making unauthorized entry into business premises, confiscation of merchandise, imposition of on-the-spot fines, and even alleged arrests—all perpetrated under the guise of conducting compliance checks related to consumer protection laws.

“It has come to our attention that unscrupulous elements are exploiting the trust and credibility of the Competition Authority of Kenya for their own illicit gains,” reads the statement. “We are deeply concerned about the impact these fraudulent activities are having on the business community and consumers alike.”

The CAK emphasized that its staff members are required to officially identify themselves and produce documentary evidence confirming the authenticity of their assignment whenever they are engaged in mandated activities such as market surveillance.

Furthermore, any entry and search activities conducted by the authority are strictly authorized through a search warrant issued by the High Court and are carried out in the presence of security officers.

“We want to assure the public that the CAK does not condone nor engage in any form of unauthorized actions,” reiterated the authority. “We are committed to upholding the rule of law and ensuring the protection of consumers and businesses.”

The authority urged affected businesses to report any encounters with individuals claiming to represent the CAK and engaging in unauthorized activities to the nearest police station.

Additionally, the CAK revealed that it is actively collaborating with relevant security agencies to investigate cases of impersonation and other illegal activities reported.

Meanwhile, the CAK has advised the public to remain vigilant and exercise caution when approached by individuals claiming affiliation with the authority. “We urge all stakeholders to be vigilant and report any suspicious activities promptly,” said the agency.
