Lawyer Danstan Omari, who has been representing Bernard Ndege, an administration police constable charged with the gruesome murder of his wife Fenny Bosibor five years ago, has withdrawn from the case.
Omari informed Eldoret Presiding Judge Reuben Nyakundi that he was no longer interested in offering legal services to the murder suspect, citing personal reasons. The seasoned lawyer’s withdrawal from Ndege’s murder trial will now compel the court to source another legal representative for the accused.
This development follows a ruling by the Judge canceling the Ksh. 500,000 cash bail granted to Ndege three years ago after he failed to appear in court more than three times for his murder trial. The Judge had initially granted Ndege a bond of Ksh. 1 million or cash bail of Ksh. 500,000 following his application to be freed from the GK remand prison.
Justice Nyakundi took action after being informed by prosecutor Mark Mugun that Ndege was being held at Kisii police station in connection with livestock theft. The Judge issued a production order for Ndege to be transferred to Eldoret GK remand, where he will be detained until his murder case is heard and determined.
Ndege, who is on interdiction, is accused of using 11 bullets to kill his wife on the night of March 9, 2019, at their Baharini police line house in Turbo Sub County, Uasin Gishu County. According to court documents, the officer shot his wife several times in the head and stomach with his assigned AK-47 rifle following a domestic dispute.
In his statement to the investigating officer, the couple’s 12-year-old son stated that he was having supper with his mother when his father arrived and shot her multiple times.
Justice Nyakundi scheduled the matter for July 30 to confirm whether proceedings from both the defense and prosecution have been typed before giving further directions.
