Attorney Kikpkorir must overcome a new obstacle in order to enter Muthaiga Club.

Muthaiga Country Club has filed a fresh application requesting the High Court to overturn orders that granted city advocate Donald Kipkorir access to its premises. The club, represented by Hamilton Harrison and Mathews advocates, argues that Justice Chacha Mwita’s orders infringe upon the club’s rights and privileges as a private members’ organization.

The club contends that Kipkorir’s request for access was improperly handled, as he did not provide sufficient reasons for his denial of entry. Kipkorir claimed that security officials at the club had failed to give a satisfactory explanation for his exclusion and noted that this was not the first instance of being denied access, citing a similar event in October 2022. He argues that, despite not being a member, he should be allowed entry to meet his clients who are members of the club, as this denial impedes his professional duties.

In response, the club asserts that the court’s order from September 9 improperly encroaches upon their rights as a private entity to control who can enter their premises. They argue that the order disregards the club’s autonomy in admitting or excluding individuals and challenges the necessity of involving the club’s current and former officials in the case.

The club’s application seeks to annul the court’s orders and remove the names of the officials from the case, asserting that the petition lacks the requisite evidence to substantiate claims of rights violations or discrimination.
