The Directorate of Criminal Investigations has informed the court that Yussuf Hussein Ahmed, the Della Ward MCA in Wajir County who was abducted two weeks ago, is not in police custody.

Justus Imana, a senior superintendent of police and the deputy DCI in the Nairobi Region, appeared before High Court Justice Alexander Muteti, who had issued a habeas corpus order last Thursday concerning Ahmed’s case.

Ahmed was taken on September 13 by unknown individuals while riding in a taxi near the Enterprise Road roundabout in Nairobi County. During the hearing at the Milimani High Court, family lawyers, including Danstan Omari, Sam Nyamberi, and Shadrack Wambui, accused police officers of being involved in the abduction.

In response to these accusations, the court ordered that the MCA’s body be produced in court on Friday or for the Inspector General of Police to provide an explanation regarding his whereabouts.

Imana stated before Justice Muteti that he became aware of the abduction on the same day the taxi driver reported the incident. “My Lord, I came aware of the incident on the same day after the report was made at the Industrial Area Police Station,” Imana said.

He added that investigations began immediately after the report was filed but have yet to be concluded. Confirming the MCA’s absence from police custody, he said, “Your Honour, I confirm before this court that the subject in this matter is no longer in our police cells, and we are working hard pursuing the incident and looking for him.”
