Lugari MP Nabii Nabwera has pointed out a key witness that Deputy President Rigathi Gachagua should be particularly concerned about as his impeachment case begins in the Senate today, Wednesday, October 16, 2024.
During a televised interview with K24 TV, Nabwera stated that DP Gachagua should be wary of Secretary to the Cabinet, Mercy Wanjau, who will testify against him. According to the Orange Democratic Movement (ODM) lawmaker, Wanjau’s testimony on charges of gross misconduct and confidentiality breaches could be significant. Nabwera explained, “There could be many issues surrounding the rule of evidence, but if I were the deputy president, I’d be most concerned about the Secretary to the Cabinet. What she’s coming to address involves gross misconduct and confidentiality.”
Nabwera also highlighted that the Senate, which will hear the impeachment case in plenary, does not need to prove all 11 charges against Gachagua to move forward with the impeachment.
As for the hearing, Gachagua and his legal team are scheduled to be introduced to the Senate between 10:30 a.m. and 11:00 a.m., followed by the reading of charges at 11:00 a.m. Each side—representing the National Assembly and Gachagua—will have 30 minutes for their opening statements. The National Assembly will then present evidence, including witness testimony, with a total of three hours allocated for evidence and two hours for cross-examination before the house adjourns for lunch at 1:00 p.m.
After the lunch break, the National Assembly will continue presenting evidence from 2:30 p.m. to 6:30 p.m. This will be followed by a session where senators can ask questions or seek clarifications from 6:30 p.m. to 7:30 p.m., after which the house will adjourn for the day.
