Court of Appeal declines to stop auction of Nairobi’s 14 Riverside Drive complex

The Court of Appeal has declined to grant interim orders stopping the planned auction of Nairobi’s iconic 14 Riverside Drive complex, paving the way for the sale scheduled for 26 May 2026.

In an order issued on 18 May 2026, the appellate court stated that it would deliver its ruling on 27 November 2026 after hearing an application for an injunction filed under Rule 5(2)(b) of the Court of Appeal Rules.

The applicant had sought interim orders to stop the intended public auction of the property pending the court’s ruling. However, the application was strongly opposed , with the court ultimately declining to issue the temporary injunction.

The dispute centres on a multi-billion-shilling commercial battle dating back to a 2010 property transaction between Synergy Industrial Credit Limited and Cape Holdings involving the Riverside development.

At the heart of the case is a deposit of about Ksh.577 million paid toward the purchase of an office block within the complex. The deal later collapsed, with Synergy seeking a refund over alleged delays in the project, while Cape Holdings argued that the delays were occasioned by design changes requested by the buyer.

The debt linked to the dispute has reportedly ballooned to more than Ksh.10 billion, prompting the scheduled auction of the landmark property later this month.
