Court orders DNA test for man accused of impregnating a minor

An Eldoret court has ordered the DNA test of a 30-year-old man accused of defiling and impregnating a minor to establish if he is the newborn’s father.

Eldoret senior resident magistrate Daniel Sitati directed the police to escort the suspect, Geofrey Ouro, the minor, 16, and her child to the Government chemist in Kisumu where the DNA tests will be conducted.

Sitati ordered that the police can hold Ouro in custody for three days so that the tests can be done before charges against him can be filed in court if the results prove the allegations.

The magistrate earlier dismissed the police request to detain the suspect for five days noting that three days were enough for the police to accompany him to Kisumu for the tests.

He said that the accused person had been cooperative with the investigators since he has been reporting to the police station monthly after his release on bond early last year after a defilement case against him was filed.

Corporal Agnes Mueni had filed a miscellaneous application in court seeking to have the suspect detained in custody at Yamumbi police station and for the DNA tests to be conducted after the minor gave birth days ago.

The officer stated in her application that a defilement case against the suspect had been reported at the police station on May 16, 2024.

She said the suspect had been arrested and released on police cash bail awaiting the birth of the child so that more investigations would be conducted.

The matter is set to come up for mention on January 9, 2025.
