Gachagua wants court to declare him retired to get state benefits; Uriri MP claims

Uriri Member of Parliament Mark Nyamita has called out former Deputy President Rigathi Gachagua for what he termed as seeking state benefits while having political ambitions.

The MP referred to Gachagua’s petition seeking the court to review his October 2024 impeachment, which he termed unconstitutional.

“What is it that you are actually seeking from that particular case, because if you do not want to get back to the office, but you want to get benefits,” Nyamita argued during a panel discussion on Citizen TV.

“Because one of the prayers in that particular petition was that he be paid for the period until the end, so Rigathi Gachagua wants to be paid for work not done,” he added.

Nyamita termed this move unacceptable and called on the legislature to determine the involvement of retired public officials in politics.

“Today, retired public officials are given public vehicles, fuel, security, and they go on to rallies. It means that the taxpayer is actually paying for that politics. If we are not very careful, then every other public officer will be active out there in politics but being paid for by the taxpayer,” stated Nyamita.

Nyamita raised questions as to what Gachagua really wanted from the judiciary.

He maintained that the case should proceed up to the Supreme Court with the sole purpose of jurisprudence.

Further, the legislator listed other political players, including former President Uhuru Kenyatta, Kalonzo Musyoka, Justin Muturi and David Maraga as beneficiaries of the state.

Nyamita wished that Gachagua would get on the ballot for Kenyans to “finally impeach him”.

The High Court on Monday dismissed Gachagua’s petition and upheld the impeachment process conducted by Parliament.

In a detailed judgment delivered on Monday, Justices Eric Ogolla, Anthony Mrima and Frida Mugambi rejected the key arguments advanced by Gachagua.

The former DP has since indicated that he will move to the Court of Appeal to challenge the High Court judgment that upheld his impeachment.

Gachagua’s legal team said they have already filed a notice of appeal shortly after a three-judge bench of the High Court dismissed his petition challenging the impeachment process undertaken by Parliament.
