The High Court in Kiambu has lifted conservatory orders that had barred the arrest or detention of governors and other affected individuals, after the petitioners sought to amend their case.
Justice Bahati Mwamuye vacated the interim orders, finding that the proposed amendments had fundamentally altered the legal basis of the petition.
In his ruling, the judge said the changes introduced new issues that were not part of the original pleadings, making it untenable for the interim protections to remain in force.
The conservatory orders had previously shielded governors and certain public officials from arrest or detention pending the hearing and determination of the case.
With the orders now lifted, law enforcement agencies are no longer restricted by the earlier court directives.
The matter is expected to proceed on the basis of the amended petition once it is filed and served.
