Man in trouble for failing to report housemate who defiled 17-year-old schoolgirl

A 27-year-old man is facing criminal charges for failing to report to the police after his housemate took a 17-year-old girl to their shared house in Sabasaba area within Embakasi East in Nairobi.

Mr Elly Ochieng Oyoo was arraigned at the Makadara Law Courts where he was charged with aiding his housemate to escape a jail term of 15 years. He is facing charges of accessories after the fact contrary to section 396 (1) as read with section 397 of the penal code.

Mr Oyoo is accused of harbouring Alloys Ouma having knowledge that he was guilty of an offence of defilement of a child in order for him to escape punishment. The suspect met the minor at a bus stop and lured her to the house where he lived with Mr Oyoo.

The family of the minor learnt that she was living with Mr Ouma and some relatives proceeded to the house to look for her but Mr Ouma escaped with her.

The minor, who is a student at a school in Machakos County, was later traced and found. She confessed that she had been living with the suspect who is still at large. She told her family that she had left her school bag, clothes and books at the house where My Oyoo and Mr Ouma lived.

The matter was reported to the police and officers visited the house where they recovered the minor’s belongings and arrested Mr Oyoo. He denied the charges before Principal Magistrate Eric Mutunga of Makadara Law Courts.

Mr Mutunga ordered for a pre bail report before setting bail and bond terms for the suspect. Mr Oyoo will remain in remand until May 23, 2023 when the pre-bail report will be tabled by the probation office. Hearing of the case starts on September 13, 2023.
