Safari Rally driver Maxine Wahome has pleaded not guilty to killing her late boyfriend Asad Khan.
In her affidavit, Maxine who appeared before the court virtually on Wednesday insisted that the celebrated rally ace Khan injured himself.
While narrating the events that led to her arrest on December 12, 2022, Maxine said she was arrested by the Kilimani DCI owing to an incident that occurred at Preston Court where she resided with Asad Khan.
According to Maxine, it is during that process that she was allegedly attacked.
She claims that she took refuge on the balcony of the apartment where the deceased attempted to break down the door using his feet.
“That the deceased thereafter injured himself on the balcony door window panes and took himself to the hospital… That I was advised by my parents not to leave by the house and wait for the police,” she claims.
The rally driver further asked the court to release her on bail, saying that she will cooperate and not interfere with witnesses who shall testify in the murder case.
Through her lawyer Philip Murgor, Maxine says that she will attend court sessions at all times without fail.
“That I have been out on bail since 13th December 2022 and at no time has there been any threat to peace, security and my own safety either by the family of the Deceased and or any member of the public,” she argued.
Murgor says his client has been in custody since March 7, and that a charge sheet was filed and not provided to the accused person.
“She is languishing in police station,” he said, adding that there is a bail application before the court.
