Mombasa: Man sentenced to 30 years in prison for incest, defilement

A 40-year-old man has been sentenced to 30 years in jail after being found guilty of incest and defilement.

Mombasa Senior Principal Magistrate Vincent Adet convicted and jailed Benard Anjera Manyasi for 30 years for committing the act of incest with his 14-year-old daughter.

Adet ruled that the act contrary to section 20 (1) of the sexual offences act no 3 of 2006 left lifetime trauma on the mind of the young girl.

Manyasi committed the beastly act on his own daughter on diverse dates between 1 January 2017 to 16 July 2019 in the Kaa Chonjo area in Mombasa sub-county, Mombasa County.

The court ruled that the prosecution through the Principal’s prosecution counsel, Hillary Isiaho, who presented five witnesses proved the case against the accused to the required legal standard.
Incest

The magistrate also found the man guilty of committing an indecent act with his daughter by touching her private parts.

At the same time, the magistrate sent Danson Odondo to 20 years in jail for defiling a five and half-year-old minor.

The court also found Odondo guilty of committing an indecent act with the child.

He committed both offences on 5 December 2021 in the Tononoka area in Mvita Sub-county within Mombasa County.

The court ruled that the prosecution’s case was proved beyond any reasonable doubt.

In his mitigation Odondo asked the court for a lenient sentence, arguing that he was HIV positive and he was on medication.

He further told the court to consider his earlier application in which he had sought to be tested for HIV alongside the minor a defence that would have been used as ground by the suspect in case the minor tested Negative for HIV.

“I had applied to be tested for HIV and if l turned out to be positive, chances are l must have infected the minor a plea that had been thrown out by the court,” he stated.
