A teenager has been sentenced to 60 years’ imprisonment for defiling a five-year-old girl. Kericho Senior Principal Magistrate Johnson Monguti sent Emmanuel Kemboi, 19, to prison for the offence that he committed on March 8 this year at his house in Kenyelet village in Kipkelion West Sub-county.
According to the prosecution, Kemboi lured the minor to his house under the guise of giving her avocados.
The court heard that, on the fateful day around 4 pm, the minor, a Pre-Primary One pupil, was playing outside her grandmother’s house together with her sister and friends when the accused called out her name and asked her to accompany him to his house, promising to give her avocados.
“Instead of giving her avocados, he dragged her into the bedroom where he committed the offence,” the prosecution said. A witness told the court that she caught the accused red-handed in the act, at which point he picked up a stone and hurled it at her but missed. He then fled the scene.
The witness, together with other neighbours, rushed the girl to hospital. She was treated and the matter was reported at Barsiele Police Post. A medical officer who examined the girl confirmed that she had been defiled.
In his ruling, Mr Monguti said the prosecution had provided enough evidence to prove its case.
“The court has established beyond reasonable doubt that the accused person committed the heinous act,” he ruled. Kemboi has been given 14 days to appeal the sentence.
