The United States government has issued clear guidelines regarding the limitations placed on holders of visitor visas, specifically the B1/B2 category.

These visas, intended for business and tourism purposes, come with strict regulations, and breaching them can lead to severe immigration consequences.

Understanding B1/B2 Visa Restrictions

Visitor visas are strictly for temporary visits, granting holders the right to travel for business or tourism.

However, the US government emphasizes that this does not equate to a free pass for any activity once on American soil.

Engaging in activities that fall outside the specified purpose of the visa can lead to automatic cancellation, rendering future visa applications at risk.

The US government has delineated seven specific activities that visitor visa holders are expressly prohibited from undertaking:

  1. Study – Enrolment in academic courses is not permitted.
  2. Employment – Any form of paid work is strictly prohibited.
  3. Paid performances – Performing for monetary compensation before an audience falls outside the visitor visa’s scope.
  4. Arriving as a crewmember – Individuals cannot enter the US as crewmembers on ships or aircraft.
  5. Working as foreign press – Media professionals cannot conduct work in journalism or related fields without a specific visa.
  6. Permanent residence – Using a visitor visa to attempt settlement in the US is a violation of the terms.
  7. Birth tourism – Travelling to the US primarily to give birth for the purpose of conferring citizenship to the child is not allowed under a visitor visa.

Consequences of non-compliance

The US government has made it known that failing to leave the country before a visa expires places holders out of status, leading to automatic cancellation of the visa under Section 222(g) of the Immigration and Nationality Act.

This disqualification can affect future visa applications as well.

For cases where an individual’s situation changes while in the US such as receiving a job offer or marrying a US citizen it is possible to seek a change of nonimmigrant status through the US Citizenship and Immigration Services without leaving the country.

However, departing the US after such a change necessitates applying for a new visa in the appropriate category.
