Farzana Nur Butt was arraigned before Senior Resident Magistrate Gladys Olimo, who directed that she be released on a bond of Ksh.1 million with a surety of a similar amount.
According to the Office of the Directorate of Public Prosecutions (ODPP), Farzana faced three counts of trying to acquire Susan Wanjiru’s land fraudulently.
In the first count, she was charged with conspiracy to defraud, contrary to Section 317 of the Penal Code, jointly with her relatives Jamshed Ahmed Butt and Fahmeda Begum Butt, who were not before the court.
They allegedly conspired to defraud Susan Wanjiru of her parcels of land, LR. Mombasa/MS/Block 1/1944 and Mombasa/MS/Block I/1945, on diverse dates between July 12, 2006, and October 20, 2026, within the Coast Region.
The two parcels of land, valued at Ksh.100 million and registered at the Mombasa Land Registry, were allegedly claimed without the authority of Susan Wanjiru.
Farzana later registered the same parcel in the name of her relatives.
In the second count, Farzana is accused of inserting Title Lease No. Mombasa/MS/Block 1/416 into the land records at the Mombasa Land Registry on July 12, 2006.
“The accused allegedly committed the offence with intent to deprive Wanjiru of the two parcels of land situated in Likoni, Shelly Beach, by inserting the lease into the land records, a fact she allegedly knew to be false,” she said.
The third count was for forcible entry, for allegedly entering the contentious premises without the authority of the registered owner.
The accused pleaded not guilty to all the charges. Through her lawyer, she applied to be released on a reasonable bond term, saying she has a fixed abode within the jurisdiction.
The pre-trial conference for November 12, 2026.
