The accused, John Vianney Onyango, also known as “Jay Vee Ke”, is alleged to have posted messages and videos on his Facebook page claiming that relief food distributed through Prof. Ojienda’s office had been mismanaged and that residents had raised concerns over contaminated maize flour.
According to the charge sheet, Onyango allegedly posted on April 14, 2026, a video accompanied by a caption stating that an elderly woman had been brought to tears because of alleged cons linked to Ojienda’s office.
In a second count, he is accused of posting on April 16, 2026, that residents of Kisumu Central were going hungry due to alleged political interference in the distribution of relief food.
The prosecution further alleges that on April 29, 2026, Onyango published a video claiming that residents had called for investigations into allegedly contaminated maize flour distributed through Prof. Ojienda’s office and coordinated by a county official.
The State contends that the accused knew, or ought to have known, that the communications would detrimentally affect the reputation of Prof. Ojienda, contrary to Section 27(1)(b) as read with Section 27(2) of the Computer Misuse and Cybercrimes Act, 2018.
Addressing the court Senator Tom Ojienda we told the court that the accused had allegedly made a habit of publishing such content.
“That is what he does. We are not dealing with one post; he will be here many times,” Ojienda said.
The senator further alleged that the accused created and published the posts himself, maintaining that the claims made on the Facebook page were false.
