A suspect stunned a Milimani court on Monday, February 13, 2023, after revealing that he lost his “very expensive” prosthetic eye during his arrest in Nairobi on Saturday, February 11, 2023.

Juma Hamisi Naiseria who was arraigned to face charges of robbery with violence told the court that police officers from Central Police station beat him up leading to the destruction of his prosthetic eye that cost him a whopping Ksh120,000.

Hamisi narrated that the eye fell from the socket after he was beaten by police officers during his arrest.
Eye destroyed completely

According to the suspect, his pleadings to have him collect his prosthetic eye from the ground fell on deaf ears as the officers stepped on it, destroying it completely.

“Your honour when I was arrested I was beaten by the police officers on the head and my eye fell. I requested the officers to let me collect the eye but instead, they stepped on it, destroying it completely. The eye was very expensive. It cost me Ksh 120,000,” Hamisi told Chief Magistrate Susan Shitubi.

The suspect who appeared in court with one eye urged the presiding magistrate to order the police to escort him to hospital for treatment.

At the same time, Hamisi co-accused persons Charles Juma Marwa and Josphat Muriasi Ondigo also told the court that the cops assaulted and stole cash from them during their arrest.

“I pray to be taken to the hospital, the officer who arrested me assaulted me and took my money,” Juma informed the court.

Juma, who stood in the dock with his right hand tied with a shoelace as a support mechanism, insisted that he suffered serious injuries on his hand during the incident.

On the other hand, Muriasi appeared in court with his face swollen and sought to be taken to hospital, saying his head was aching from the beatings he endured from the arresting officers.

The three suspects were charged with robbery with violence contrary to section 296 of the penal code.

The prosecution alleges that the three accused persons on February 11, 2023, along Tom Mboya Street in Nairobi violently robbed the complainant Silvester Muli Mwongela of a Tecno Cammon 11 phone valued at Ksh17,500.

The trio denied the charge and were released on a bond of Ksh 200,000 each.

The court further ordered that in case they were unable to raise the bond terms the prison authorities to escort them to the hospital.
