The Court of Appeal in Kisumu has given a reprieve to over 200 traders at Nyamlori market after it ordered a stop to their eviction from the market by the City Management planned for the 16th this month.
Justices Hannah Okwengu, H.A Omondi and Joel Ngugi ordered the traders to stay put pending hearing and determination of the appeal filed by their lawyer Joshua Nyamori.
The court has also ordered both parties including the traders and the city management to undertake a meeting so as to find an amicable settlement of the dispute.
The judges in the virtual ruling last evening ordered that if no agreement shall have been reached after 90 days, then a date for hearing will be set.
Nyamlori traders and the city management led by Abala Wanga have had a back and forth over the notice to have the traders leave the market area. The city management argues that the stalls are built on sewer lines leading to constant drainage blockages in the city.
