Director of Public Prosecution Renson Ingonga has approved murder charges against 15 officers from the disbanded Special Services Unit (SSU) for the disappearance of two Indians and their Kenyan taxi driver.
The case, which had begun its trial at Kahawa Law Court, will now proceed to Kiambu High Court where the accused will face fresh murder charges.
The 15 officers are accused of abducting and causing the disappearance of two Indian nationals, Zulfiqar Ahmed Khan and Mohammed Zaid Sami, along with their taxi driver Nicodemus Mwania Mwange, between July 22 and July 23, 2022, in Nairobi County.
The officers involved include Peter Muthee Gachiku, James Kibosek Tanuki, Joseph Kamau Mbugua, David Chepchieng Kipsoi, Joseph Mwenda Mbaya, John Mwangi Kamau, Hillary Limo Kipchumba, Stephen Luseno Matunda, Simon Muhuga Gikonyo, Paul Njogu Muriithi, Boniface Otieno Mtulla, Elikana Njeru Mugendi, Fredrick Thuku Kamau, John Wanjiku Macharia, and Michael Kiplangat Bett.
During the hearing in March this year, the first witness, Officer Kennedy Ndeto from the Internal Affairs Unit, testified that the accused were placed at the scene of the crime.
Ndeto told Principal Magistrate Gedion Kiage that tracking logs of the vehicle used by the accused showed they entered Aberdares National Park through the Treetops gate at 6:34 pm.
He also stated that call data records placed the accused in various areas of interest, including the SSU offices in the Old Nairobi area and locations along the Nairobi-Nyeri road, specifically Muiga in Nyeri, leading up to Aberdares National Park.
