Attorneys want access to details on the Adani and Ketraco agreement.

Lawyers are now requesting access to information concerning agreements between the Indian firm Adani Energy Solutions, a subsidiary of Adani Group, and the Kenya Electricity Transmission Company Limited (Ketraco).

In a letter obtained by Business Hub, OC Law Advocates LLP has formally addressed Ketraco’s Managing Director, seeking to exercise their right to access information regarding the agreements between the two parties.

“Our firm has learned that your organization plans to execute various agreements with Adani Energy Solutions (formerly Adani Transmission Limited) for several Public Private Partnerships in Kenya,” the letter stated.

The lawyers are requesting details on the project agreements between the companies, the financial capacity of the tendering company, and the tendering process undertaken. They also seek access to the legal, regulatory, social, economic, and commercial viability appraisals, public participation records, approval from the Attorney General, and any undertakings, letters of support, or risk guarantees issued by the ministry within Ketraco’s knowledge.

This request follows Adani Energy Solutions receiving approval for a multi-million-dollar energy transmission project in Kenya under the private-public partnership framework. The approval comes amid intense public debate over another deal involving the Adani Group, despite its controversial global reputation.

The approval was granted after the private-public partnership committee conducted what it described as a ‘thorough evaluation and financial risk assessment,’ along with ‘extensive negotiations’ between the two companies.

The lawyers have given Ketraco 14 days to provide the requested information, warning that failure to comply will lead them to exercise their rights in accordance with the law.
