A lawyer has raised concerns about the decision to charge an assault victim, a student at Kilimambogo Highways Building Technology Institute. Lawyer Patrick Gaitho questioned why the police decided to take his client, the victim, to court over allegations of assault and damage to the institution’s property.
“This is an attempt to deter justice for the young man,” he told the court.
John Maina, who was reportedly assaulted by school instructors on May 9, 2024, appeared before Principal Magistrate Paul Wechuli and denied the charges. The assaulters were also charged with offensive conduct directed at the student, using abusive words with the intent to provoke a breach of peace and to kill Maina.
Kevin Nabali, Gentrics Shikuku, and Laban Kemboi appeared before Kithimani Law Courts in Yatta, Machakos County, to plead before Principal Magistrate Paul Wechuli.
The three allegedly caused Maina to sustain serious injuries, requiring treatment at Kilimambogo Level Four Hospital. They denied the charges and were released on a cash bail of Sh10,000 or an alternative bond of Sh30,000 with a surety of a similar amount.
In a video , the accused persons are seen beating and kicking Maina before he falls and is crowded. He then wakes up and walks off. The case is set for mention on July 29, 2024.
