Bar manager, bouncer who locked up patrons over unpaid bill charged with kidnap

A bar manager in Nairobi and a bouncer who locked up two revelers in a store at a popular club along Thika Superhighway for failure to clear a bill are facing charges of kidnapping with intent to confine.

The club manager of Embassy Bitros Club, Henry Philip Omondi, and James Angulu, a security officer at the club, are accused of secretly and wrongfully confining Fredrick Kioko and Kevin Oira at the club located at Roasters area in Kasarani Sub County on June 24, 2023 contrary to section 259 0f the penal code.

The two are also facing charges of obstructing Corporal Jackson Okeyo and Police Constable William Kimutai attached to the Directorate of Criminal Investigations (DCI) Kasarani offices from rescuing the two complainants, contrary to section 254 (b) of the criminal procedure code.

They are also facing a charge of creating a disturbance in a manner likely to cause a breach of peace in contravention of section 95 (1) (b) of the penal code.

The two allegedly banged the bonnet of a motor vehicle – KCG 895K – belonging to DCI and snatched the ignition key from PC Kimutai who was the driver.

The two complainants had gone to meet their friend at the club in the morning and found him having drinks in company of a woman and two men.

After a short while, their friend excused himself to escort the woman to the car outside because she was overly drunk and the two other men also left leaving the two complainants alone at the table where they continued taking beer ordered by their friend who left with a woman.

They later discovered that their friend had left with the woman without paying and they were ordered to pay the bill of nearly Sh10,000. They declined and were subsequently locked up in the club’s store.

They called their friends who reported the matter to the police control room and the same was escalated to the Kasarani DCI offices. Three officers on night patrol, including Cpl. Okeyo and PC Kimutai, proceeded to the club to rescue Mr Kioko and Mr Oira.

The detectives freed the two complainants but Mr Omondi and Mr Angulu together with other workers at the club allegedly blocked the officers from leaving with the complainants.

In the process, the two suspects are said to have banged the car’s bonnet before snatching the keys from Mr Kimutai. Mr Omondi was arrested as the others escaped and Mr Agulu was traced later and arrested.

The accused persons denied the charges before Senior Principal Magistrate Gerald Mutiso of Makadara Law Courts. They were released on a bond of Sh50,000 with a surety of a similar amount and an alternative cash bail of Sh20,000. The cases will be mentioned August 1, 2023 for pretrial.

The two complainants are listed as witnesses alongside Cpl. Okeyo and PC Kimutai.
