High Court has ruled that the Kenyatta International Convention Centre (KICC) belongs to the Government of Kenya ,dismissing a petition by the Kenya African National Union (KANU) party seeking to be declared the owner .

In a ruling on Monday, Judge Jackline Mogenyi said that the commissioner of lands in 1989 had no power to alienate the land to KANU.

“The suit property as registered issued in the name of PS under ministry of tourism is appropriate,” court ruled.

While revoking the title deed in the name of KANU, court noted that the allocation of KANU without following due process is illegal and unconstitutional.

“A declaration that Ministry of Tourism is the lawful owner of the land and KANU registration is unlawful, illegal and unconstitutional,” court declared.

For years, KANU has claimed ownership of the property, and had listed it among its assets in filings to the Registrar of Political Parties.

KICC was thought to be the property of KANU until President Mwai Kibaki’s government took over it in 2003.

Now, the property is among those sent for privatisation.
