CCTV footage showing former Tetu Member of Parliament James Gethenji assaulting a security guard at the upmarket Kihingo village in Kitisuru was on Tuesday played in court.

Gethenji was charged in 2021 with assaulting Godffrey Kirimi Mutua, who was a security guard at Kihingo village on February 5, 2021.

On Tuesday, the court was taken through the events that took place on February 5, 2021, with forensic examiner Samson Otieno playing the CCTV videos showing how the security guard was assaulted.

“The video clearly shows that the accused also pushed a police officer in uniform who is also part of the security team of the estate,” Samson told Senior Principal Magistrate Dolphina Alego.

The court heard that on the day of the incident, a Toyota Vanguard approached the main entrance of Kihingo village with the front seats fully occupied.

The CCTV footage showed the former legislator holding a brief conversation with them and he later went back to his car and entered the estate.

During cross-examination, Samson was asked by Gethenji’s lawyer Churchill Otieno whether he knew it was the former legislator who installed those cameras to which he responded he did not know.

The case was adjourned until July 20 after the court was told that another witness who was to testify was unwell.

Gethenji is embroiled in a bitter row with his sibling over an upmarket city estate which consists of 55 houses. The two brothers have one share each in the management company, a clubhouse and social amenities.
