A second director of a city company has been charged with forging an Sh500 million title deed of an up-market property belonging to 2022 presidential candidate Jimi Wanjigi.
Henry Njoroge Njenga was arraigned before Milimani chief magistrate Lucas Onyina where he denied 24 counts of land fraud.
Njenga was charged two weeks after Horizon Hills Limited (HHL) director Samuel Njuguna Chege was arraigned over the same illegal land transaction.
Njenga and Chege, 53, allegedly pretended to be a directors HHL when they allegedly acquired the parcel of land which houses the offices of the Kwacha Group of Companies.
State prosecutor Anderson Gikunda did not oppose the application by Njenga to be freed on bond.
“Seven other suspects are yet to be arrested and arraigned over the same land transaction,” Gikunda told Mr Onyina.
The prosecutor said two weeks ago another chief magistrate Susan Shitubi ordered for the arrest of
David Njenga Samson Kuria, Njenga, Antony Masengo Anabaka, Cissy Kalunde Musembi, Valentine Jelimo Kibire, Lawrence Njogu Mungai, Kepha Odhiambo Okongo and Martin Esakina Papa.
A Lands Registrar Cattwright Jacob Owino was spared the warrant of arrest as she fell sick while in police custody and rushed to a hospital for urgent medication.
Njenga was represented by Karathe Wandugi who said the accused is of no means and cannot raise a Sh500,000 cash bail imposed on Chege by Ms Shitubi.
“I urge this court to free the accused on bond.He cannot raise a Sh500,000 cash bail,” Wandugi told Onyina.
The court heard that there is a pending High Court case over the ownership of the land in question and that the complainants-Wanjigi and his wife Irene are parties.
Njenga denied 17 counts filed against him and the co-directors of Horizon Hills Limited.
They are charged with falsely pretending that Velji Premachand Dodhia and Himanshu Velji Premachand Dodhia had sold and transferred the Wanjigi land for a consideration of Sh33,600,000 to Horizon Hills Limited.
The offence was allegedly committed on April 5, 2018.
Njenga faces other charges of procuring the registration of a parcel of land situated along General Mathenge Road within Nairobi County in his name and others.
