Court issues more time for Echesa to be arraigned in Ksh.39B fake firearms case

The defence has been given more time to present former Sports CS Rashid Echesa and another suspect in a case where the High Court directed that the Ksh.39 billion fake arms matter be heard again before the magistrate court.

This is after Echesa failed to show up in court saying that he is bereaved.

The defence asked the court to allocate a trial court to hear the matter. The matter will be mentioned on 28 of this month.

Meanwhile, two of his co-accused persons who appeared in court on Monday have been directed to deposit cash bail inorder to be free pending determination of the matter.

Last week judge Kanyi Kimondo ruled that the prosecution had presented a strong case against Echesa and that the trial court should have found him with a case to answer, thus requiring him to defend himself rather than acquitting him and directing that the case be taken back for trial.

Last week, Echesa’s acquittal in the Ksh.39 billion fake arms case was overturned by the High Court in Milimani.

High Court Judge Kanyi Kimondo delivered the judgment, stating that the trial magistrate had erred in acquitting Echesa due to a lack of testimony from certain witnesses.

Judge Kimondo ruled that the prosecution had presented a strong case against Echesa and that the trial court should have found him with a case to answer, thus requiring him to defend himself rather than acquitting him.
