Court summons Principal Registrar of Persons after conflicting death certificates in Ksh.30M land case

An Eldoret court has summoned the Principal Registrar of Persons in a case where two families are battling over a 30 – acre prime piece of land estimated at Ksh.30 million in Uasin Gishu County.

Justice Robert Wananda directed the senior government official to appear before him without failure on July 21 in regards to the two conflicting death certificates presented before him in a land ownership dispute.

The senior government official is to unravel who between the late Philip Cherono and the late Paul Kibet Cherono is the owner of the disputed property.

Justice Wananda’s order stems from the strange turn of events where the feuding parties presented two conflicting death certificates in court during the hearing of the case.

The court has noted that the documents have variations in names and differences in the year of death of the said original owner of the agricultural land which is located in Kaptagat settlement scheme in Ainabkoi sub county.

According to the family of the late Philip Cherono, led by his elder son Clady Cheruiyot, their father died in 1976 as indicated in the death certificate they presented before Justice Wananda.

However, in a quick rejoinder, Abraham Chebii a senior driver with the Judicial Service Commission, told the court that his father Paul Cherono died in 1997 as indicated in the death certificate he availed in court.

The two feuding families have been battling in the corridors of justice over ownership of the property since the deceased persons passed away.
