Gachagua now seeks compensation for full 5-year term citing ‘unlawful’ impeachment

Former Deputy President Rigathi Gachagua now seeks to amend his ouster petition to claim damages, citing what he terms as an unlawful impeachment.

Gachagua is asking the court to grant him leave to revise his original prayers, abandoning his initial request for reinstatement to office.

Instead, the court was informed that he will now pursue compensation equivalent to what he would have earned had he served the full five-year term.

Gachagua, through his lawyer Paul Muite, stated that he no longer wishes to proceed with the case as initially filed and will not be seeking any declaration for reinstatement.

“The petitioner wishes to challenge the legality of his impeachment and will be seeking leave to amend the prayers. He will be asking for the money he would have earned had he served the full five-year term,” Muite told the court.

Muite further emphasized that he will not be filing any interlocutory application, and requested the court to assign the earliest possible hearing dates.

“This petition is not a matter of public interest. It is a personal matter that directly affects the petitioner, who is the one impeached,” Muite said.

The respondents in the case did not object to Gachagua’s application to amend the petition.
