I have no criminal case, Aisha Jumwa argues in case challenging her appointment as CS

Public Service and Gender Cabinet Secretary Aisha Jumwa has told court that she is not facing any criminal case.

Jumwa, while responding to a case challenging her nomination as CS filed by Eliud Matindi in 2022, told justice Mugure Thande that charges against her were withdrawn and therefore the case before the court has been overtaken by events.

Through lawyer Danstan Omari, she submitted that there’s a procedure for removing CS’s from office.

She says that high court has no jurisdiction to hear the matter and therefore the court should dismiss the case.

The Director of Public Prosecution and Attorney General have also filed a preliminary objection into the case.

DPP through lawyer Alexander Muteti confirmed to the court that cases against Jumwa were withdrawn adding that court can’t undo that.

Justice Thande directed that the preliminary objection filed in the case should be heard first.

Submissions will be done on June 8, 2023.
