Nairobi Senator Edwin Sifuna has called for an end to the impunity surrounding the disregard of court orders. In a recent statement, Sifuna emphasized that there are court orders in place prohibiting the arrest of businessman Jimi Wanjigi, and these orders must be upheld. He described the disobedience of such orders as a breach of the Constitution of Kenya.
Sifuna urged the Judiciary to ensure that Wanjigi is released immediately in accordance with the existing court directives.
“I don’t like #Wanjigi. But I like court orders and the rule of law. There are existing court orders barring this arrest. The Kenyan Judiciary must set him free immediately after he is presented to them,” Sifuna said on X.
Jimi Wanjigi was arrested and detained at Kamukunji Police Station on Monday despite having court orders that prevented his arrest. He had been summoned to provide a statement at the Nairobi Area DCI offices and arrived with his legal team around 2 p.m., where he was subsequently taken into custody.
It has since been revealed that Wanjigi’s arrest was related to a revoked firearms license. The Firearms Licensing Board had reportedly instructed him to return the license. However, Wanjigi clarified on X that a 2018 court ruling had nullified the Board’s decision to revoke his firearms certificate, number 5922, following a petition he filed in 2017.
Wanjigi also stated that the Director of Public Prosecutions (DPP) had directed the DCI in November 2022 to comply with the court orders regarding his firearms, but this directive has not been followed to date.
