Kisumu court summons IG Kanja, AG Oduor over protest regulations

A Kisumu High Court has ordered the National Police Service, the Inspector-General of Police Douglas Kanja and Attorney-General Dorcas Oduor to appear before it and show why disciplinary action should not be taken against them, after they were found in contempt of court.

Justice Alfred Mabeya, in his ruling today, said the three were directly defying the court through their continued operation without gazetting regulations on public order management and the use of force that may infringe on the right to picket.

In a landmark judgment, the court found that state agencies violated fundamental rights guaranteed under the constitution, including the right to life, dignity, equality, and security of the person.

The High Court in Kisumu had in March awarded Ksh.38.6 million to victims and families affected by police brutality during protests in Kisumu.

During the award, the court had issued orders aimed at reforming how demonstrations are managed in the country and directed the AG and IG to have the regulations in place.

Justice Mabeya noted that the two offices did not comply with the orders, nor did they seek an extension, adding that they must appear before him on July 21, 2026.

LSK Kisumu chairperson Dorcas Oluoch, who is a party in the suit, noted that the ongoing compensation is not an excuse to evade long-lasting reforms, underscoring the need for state agencies to fully comply with the courts’ directives.
