Lawyer Danstan Omari has now threatened to take legal action against National Assembly Majority Leader Kimani Ichung’wah over an alleged defamatory tweet.
This comes after Omari, during a past interview on NTV, fingered the President William Ruto administration and, more specifically, Ichung’wah over what he termed as the harassment of former President Uhuru Kenyatta.
“We have a new regime that wants to drag Uhuru Kenyatta to court, and as lawyers we will make money to defend him, but what will be the impact? The retired president has a lot of force globally…Raila Odinga and Uhuru Kenyatta, globally, control 80 per cent of the networks,” said the advocate during the February 1, 2023 interview.
“William Ruto is a local President, and the likes of Ichung’wah are only known upto Kikuyu Constituency…we’re dealing with a new war that Kenya Kwanza could’ve withdrawn.”
Ichung’wah, who is the Kikuyu Member of Parliament, however did not take the remarks lying down, firing back at the lawyer in a quoted retweet.
He hit back saying: “Phewl At least am known in Kikuyu by my people unlike the fake media based liar only known along Koinange Street!”
Omari, in a letter drafted by his lawyer Brian Mabeya, has termed the response as defamatory and meant to portray him in negative light.
He hence wants the Majority Leader to withdraw the said tweet and apologize to him within a week, failure to which he promised to drag him through the corridors of justice.
“The import of your impugned tweet was to portray our client as a person of loose morals, a person who keeps the company of prostitutes and an immoral person, never mind the fact that our client is an advocate of several years standing and has been a lecturer of law,” wrote lawyer Mabeya.
“He is also a father and a married man, and a known commentator on various public issues on media. Your tweet was therefore calculated to injure the image and character of our client in the eyes of the public.”
Mabeya further added: “It is our demand therefore that you retract the offensive tweet and apologize to our client within seven days (7 days) of the service of this letter, failure to which we will have no option but to seek legal succor without any further reference to yourself and/or associates.”
