The Chairperson of Makini School’s Parents Teachers Association (PTA), Nixon Bugo, has been restrained from making defamatory statements against the institution and its Regional Director Horace Mpanza.
The order was issued by Milimani Commercial Principal Magistrate Sammy Aswani Opande.
“A permanent injunction restraining the defendant (Bugo) from posting or making any statements or utterances whatsoever regarding the plaintiff, “reads the order dated July 17.
The magistrate further directed that the application filed by the school and Mpanza be served to Bugo for inter parties hearing on August 2.
In the application, the school together with Mpanza claim that on July 8, 2023, the PTA chair called for a virtual meeting of parents which was attended by over 100 parents.
The school alleges that at the said meeting, Bugo uttered various defamatory statements against it.
“The utterances and posts have caused the 2nd defendant (Mpanza) to be disliked, ridiculed and threatened by various people unknown to him. In particular, the utterances have demeaned and defamed the plaintiffs by alleging and making all to believe that he is an irrational person,” reads the application.
Mpanza further claimed that Bugo incited parents by telling them to make radical decisions against the school and himself.
In the court papers, Mpanza added that allegations claiming he has a gun are false further adding that he does not and has never owned a gun in his life.
“The defendants ought to know that there are no guns in the 1st plaintiff school and that there are security checks in the school through which no guns can be allowed,” read the documents.
The case will be heard on August 2.
On Wednesday, the High Court in Nairobi directed Makini Schools to temporarily re-admit two minors who were allegedly expelled due to the activities of their father, Bugo.
Judge Mugure Thande ordered that the children’s parents pay their school fees in consideration of their being in the institution.
The orders were to allow the minors to sit for their exams pending the hearing and determination of the case.
At the same time, Mpanza filed a response dismissing the allegations raised by the mother of the two minors.
Mpanza said Bugo incited parents during a meeting by telling them that they need to make a very radical decision against the school.
Further, Mpanza said that the contractual relationship between the parent and the school has broken down and it is no longer tenable to continue having the parent at the school on grounds that the school has lost confidence.
