Kevin Onyango Kiyogo, a resident of Kisumu, has been sentenced to death after being convicted of robbery with violence and using drugs to incapacitate his intended victim. The crimes took place on June 23, 2023, in Kogutu, Muhoroni, Kisumu County.
“The accused was charged with two counts of robbery with violence contrary to section 296(2) of the Penal Code and stupefying in order to commit a felony contrary to section 230 of the Penal Code,” said the Office of the Directorate of Public Prosecutions (ODPP) in a statement.
During the incident, Kevin Onyango Kiyogo, armed with a weapon, allegedly used violence to steal a Toyota Hilux vehicle valued at Ksh.1.8 million from James Kamau.
It was reported that Kiyogo had incapacitated Kamau with drugs before committing the robbery. The prosecution team presented eight witnesses before Senior Principal Magistrate Amos Mokoross at the Tamu Law Courts to testify on the matter.
“The court noted that all exhibits and testimonies drove to the conclusion that the accused person jointly with others not before the court indeed committed the offence on the complainant,” said the ODPP.
“In his judgement, the magistrate sentenced the accused person in the first count of robbery with violence to serve a death sentence and in the second count of administering an overpowering drug to the complainant, the accused person will serve five years imprisonment.”
The death sentence will be held in abeyance until the completion of the five-year sentence.
