Kisumu County Governor Anyang’ Nyong’o has urged the Senate to withdraw the Constitution of Kenya Amendment Bill of 2023, which seeks to prevent former governors from contesting other elective positions.

The Bill aims to bar governors after serving their 10-year term in office. Nyong’o argues that the Bill is unconstitutional, as it infringes on their right to seek elective posts, a right enshrined under Article 38 of the Constitution.

Speaking to the press in Kisumu, Nyong’o stated that he does not expect any limitations on his opportunities once he completes his term as governor.

“Having reviewed this Bill very carefully, I note the object of this Bill is to bar persons who have served as county governors from vying for election as members of parliament in the senate or members of county assembly for the first five years immediately after serving as Governor. This Bill is unconstitutional and I have myself opposed it,” said Nyong’o on Friday.

Nyong’o urges the Senate to prioritize Bills that strengthen devolution, which he believes is under threat, rather than focusing on what he terms as “cheap politics.”

As a former Senator, Nyong’o asserts that no politician should be barred from exercising their rights, regardless of previously held offices. He emphasizes that the gains of democracy, as enshrined in the Constitution, must be respected.
