A petition has been filed at the Milimani Law Courts seeking to stop the general meeting of the Kenya National Association of Probation Officers (KNAPO) or accepting any newly elected officials of the association.

The petition has been filed by five members against the association and five other respondents.

“…that pending and determination of the main petition, a conservatory order do issue restraining the respondents herein either by themselves, agents, proxies or employees from scheduling per holding an Annual General Meeting of the association or the elections of any officials of the association on the 18th of April 2024 or any other date not sanctioned by the membership of KNAPO or by further orders of this court,” reads the petition.

They say that on the 27th of March this year, one Joshua Wairuhi allegedly usurped the roles meant for the National Secretary of the Association and allegedly issued a notice inviting the membership of the association to participate in an Annual General Meeting that was to take place on the 18th of this month.

They argue that the period is shorter than what is provided for under the constitution of the Association.

They argue that the notice was issued by an unrecognized person and the form of the meeting according to them is unfamiliar with the constitutional requirement of the association.

The petitioners are apprehensive that if the annual General Meeting and elections of the new officials are allowed to proceed the petitioners and members of the association will be gravely prejudiced and their constitutional right of access to information…will be infringed, they argue

The respondents are determined to proceed with the Annual General Meeting and elections of new officials, they argue that no statements of accounts and agenda for the meeting have been shared with all the members of the Association for their scrutiny as is provided in the KNAPO constitution.
