The court has granted three petitioners permission to file their complaint against Kiambaa Constituency Development Funds manager Lorna Muthoni Njoroge before the NGCDF board within seven days.
Justice Byram Ongaya directed the petitioners to adhere to this timeline, warning that failure to do so would result in the matter being struck out with no costs awarded.
In the case, Richard Mulwa Musyoka, Richard Nzine, Nicholas Michael, and Elizabeth Mumbi petitioned the court to remove Lorna Muthoni Njoroge from office, alleging that she is unfit to serve.
During the court proceedings on Wednesday morning, the petitioners’ lawyer, Shadrack Wamboi, requested the court to stay the proceedings while they exhaust all available mechanisms.
“We are seeking the court to stay the matter so as to raise the issues with the body responsible …We have exhausted that means we can return ….was a concern that the court had raised that whether they have exhausted other internal mechanisms…,” Wamboi told the court.
However, the respondents opposed to the application and urged the court to strike out the petition arguing that the petitioners are wasting court’s time.
“Petitioners are taking court for granted because they had said that they had made those attempts…This matter can’t be stayed and therefore we ask the matter to be stuck out with cost to the second respondent,”court was told.
The judge directed that the matter be mentioned for further directions on June 27, 2024.
In the case, the the four petitioners say that Lorna is allegedly engaging in nepotism.
“She is engaged in acts of nepotism …we have raised the matter before this court …there has not been any action taken against her with relevant authorities,” the court was told.
However, Lorna has filed a preliminary objection saying that the court has no jurisdiction to hear the petition adding that it is premature.
“The application and the petition are mere schemes to perpetrate smear campaigns in an attempt to malign the second respondent name,” reads the application.
Further she says that the petitioners have been hired and are representing her estranged husband as indicated in the witness statement filed in court.
