A section of Daputo /Dafur settlement welfare scheme situated in Embakasi have moved to court seeking to have National Land Commission and Kenya Railways Corporation barred from authorizing and/or paying any compensation to the scheme .
They want the court to order the officials of the scheme officials to provide how Ksh.2 billion was utilized.
It is their argument that they relocated from the suit property on the promises that they would receive the balance of the purchase price.
“Members who had not received any money also relocated on the promise that they would receive the entire sum…The Members immediately relocated and looked for alternative accommodation, awaiting the balance as promised by the Secretary of the 1st Respondent, one Mr. John Kiyian Karu,”reads the court papers.
The 185 petitioners in the case claim that to date they have not received the balances of the sums due adding that members received varying amounts with the officials of the scheme paying themselves hefty amounts.
“From the information gathered, the amount due from Kenya Railways Corporation (15th Respondent) was Kenya Shillings Two Billion Seven Hundred and Fifty Million (Kshs. 2,750,000,000.00/-) being the sale of 55 acres at the purchase price of 50 Million Shillings Per Acre,” they argue.
They say that if the Court does not intervene, the alleged illegal enterprise will go unaddressed and it is necessary that the Court intervenes so that the principles of good governance provided for under Article 10 are reinforced.
