An Eldoret court has summoned the principal registrar of persons from the headquarters in Nairobi in a case where a senior driver attached to the Judicial Service Commission (JSC) is involved in a long-standing legal battle with a family over ownership of Ksh.100 million worth of prime agricultural land in Uasin Gishu county.
The senior government official is expected to testify on the issues of the birth document of the Abraham Chebii who has laid claim on the multi-million shillings property located in Kaptagat area.
While issuing the summons, Justice Robert Wananda directed that the officer should either present himself in person or send a representative to shed light on the parental documents of Chebii.
In his statement before the court Chebii, has claimed that he inherited the 37-acre land from his late father Paul Cherono.
Chebii also dismissed claims by the defendants in the matter that his father was childless in a scheme to disinherit him and his sister from their late father’s estate.
Chebii stated that his father sired two children, a boy and a girl before he parted ways with their mother Esther Chebet over 40 years ago.
He further told the Judge that he has documentary evidence to show that the land in ownership row belongs to his late father.
According to Chebii, his late father only leased the contested property to the late Philip Cheruiyot over 60 years ago since he had other properties in Elgeyo Marakwet county.
But in a quick rejoinder, the family of the late Philip Cheruiyot through his elder son Cledy Kiprono insists that the land belongs to their father as he dismissed the Chebii as a stranger.
They want Chebii to confine himself in Iten, Elgeyo Marakwet county where he resides and keeps off from their 37-acre land in Uasin Gishu county which they claim was an inheritance from their late father.
The matter is scheduled for mention on October 1, 2025.
