Relief for state as court dismisses petition to block Kenya Pipeline privatization

The High Court has dismissed consolidated petitions that sought to block the proposed privatization of Kenya Pipeline Company Limited (KPC), effectively clearing the path for the government to proceed with its plans.

In its judgment delivered by Justice Bahati Mwamuye, the court upheld the process outlined in Sessional Paper No. 2 of 2025, finding that it met the constitutional and legal thresholds required for such a transaction.

The judges ruled that the privatisation plan had been undertaken in substantial compliance with the Constitution and relevant statutes. The court further dismissed assertions that the process lacked transparency or posed a risk to public assets and national interests.

With the ruling, the government is now at liberty to move forward with the planned sale in line with the approved framework.
