Taxi driver in court for ‘slapping estranged wife’s aunt’

A taxi driver who allegedly threatened to kill his estranged wife and slapped her aunt is facing charges of assault contrary to section 251 of the Penal Code.

Alex Mutembei Munene is accused of assaulting and causing actual bodily harm to Elizabeth Thuranira in Kasarani, Nairobi on November 18, 2023.

He is also facing a charge of creating a disturbance in a manner likely to cause a breach of peace in contravention of section 95 (1) of the criminal procedure code.

Munene is alleged to have chased after his estranged wife who had returned to her mother’s house following a separation.

Charges against him say he uttered words “nitakuua vile niliua mungiki” to his ex-wife Susan Gacheri, which prosecution says amount to a nuisance.

Gacheri had returned to her mother’s house following domestic fights with her husband, who is the accused person.

While at her mother’s business premises, Munene arrived claiming that their children were sick and demanded a medical card to take them to the hospital.

He allegedly caused drama at the premises and left while threatening Ms Gacheri before he left.

Ms Gacheri’s mother called her sister to help resolve the dispute and Munene returned.

However, Mr Munene allegedly slapped Ms Thuranira after she turned up to help calm him down and settle the issues.

The complainants called the police to seek help and officers from Sunton Police station arrived and arrested the suspect.

Ms Thuranira who had sustained an injury on her cheek went to a hospital to seek treatment before recording a statement with the police.

Munene denied the charges before Senior Principal Magistrate Gerald Mutiso of the Makadara law courts and claimed through an advocate that his car was left on the road after he was arrested.

He urged the court to summon the officers who arrested him to account for his car.

The suspect said he was not allowed to communicate with his family and friends while in custody, who would have helped secure the vehicle.

He was released on a bond of Sh100,000 and an alternative cash bail of Sh30,000.

The case will be mentioned on November 28 when the officer investigating the matter will appear in the court and respond to the accused person’s claims. The hearing of the case will start on May 27, 2024.
