A Nairobi lawyer charged with forgery to obtain the release of an exhibit in a corruption case has been acquitted due to insufficient evidence. Milimani Senior Principal Magistrate Martha Nanzushi ruled that the prosecution did not meet the necessary standards to prove the case against lawyer Jack Bigambo.
In her lengthy judgment, the magistrate took issue with the testimonies of two advocates, Kendi Nkatha Mbatha and Grace Wambui Maina whom she said “dared to give false information” yet they are officers of the court.
Jack Bigambo was charged two years ago with forgery for allegedly using a forged stamp in the name of Grace Wambui Maina, an advocate and commissioner of oaths, on February 10, 2022.
The forged stamp was reportedly used to commission an affidavit submitted to Anti-Corruption High Court Judge Esther Maina for the release of a Toyota Prado, registration KCB 717H, owned by Benson Mwangangi Njeru.
Justice Maina ruled: “There is no cogent evidence to support the allegation that the affidavit seeking to release the vehicle to Njeru was a forgery as alleged by EACC.”
EACC had opposed the release of the vehicle claiming the affidavit by Njeru was a forgery by Bigambo.
