The court in Taita Taveta County has made a significant ruling regarding a motor vehicle that was seized as evidence in an ongoing case but was later allegedly repossessed by the seller.
Noel Mwandoe’s Toyota Probox, which was involved in a tax evasion case, was repossessed by Zenith Motors Limited. The case revolves around Daniel Ochieng’, who was found transporting uncustomed sugar using Mwandoe’s vehicle.
Mwandoe had obtained an order for the release of the vehicle in December 2023, with the condition that he would produce it when required by the court.
However, he failed to do so on May 15, leading to a summons by Principal Magistrate David Ndungi. Mwandoe explained that the vehicle had been repossessed by the seller due to his failure to meet contractual obligations.
Despite Mwandoe’s explanation, the court found his reasons for failing to produce the exhibit unacceptable, especially considering his previous commitment.
Consequently, the court ordered Mwandoe to pay a bond of Ksh.200,000 and further commit to paying the value of the motor vehicle if Ochieng’ is found guilty.
Additionally, Mwandoe is to be investigated for possible offences against the administration of justice and contempt of court.
This ruling underscores the importance of adhering to court orders and commitments, and it sets a precedent for similar cases in the future.
