Eldoret man accused of s3xually molesting son remanded

A 33-year-old man who has been accused of s3xually molesting his three-year-old son has been remanded for two weeks pending a ruling on an application by state counsel to deny him bond.

State counsel Jamalek Muriithi objected to his release on bond saying that prosecution fear that the accused is likely to interfere with the minor who is the main witness if released on bond.

The charge sheet stated that the accused defiled the minor on May 30 at D-Block area in Kapseret Sub County.

The accused person’s wife reported the incident to local nyumba kumi leaders after she noticed strange movements in the minor who was crying in pain while pointing at his father.

According to police the minor whose private parts have been injured as a result of the incident is undergoing treatment at an Eldoret hospital.

The accused was charged with defilement contrary to section 8 of sexual offences act of 2006.

He was also charged with an alternative charge of having indecent acts with the minor by indecently touching his private parts.

While appearing before Eldoret Principal Magistrate Christine Menya, the accused denied all the charges and applied to be released on bond.

According to the prosecution, the accused was left with the complainant when his wife went to a local market where she sells vegetables.

When the mother returned from the market and realized that all was not well, the accused allegedly kicked her out of the house together with the victim before reporting the incident to nyumba kumi leaders.

He was later arrested by police officers from D-Block Police Patrol base.

The magistrate ordered for a pre bail report to ascertain whether the accused qualify to be released on bond.

The case will be heard on June 21 when a pre-bail report will be presented in court.
